General terms & conditions

  1. SCOPE & CONTRACTUAL PARTNER
    1. These General Terms and Conditions, hereinafter referred to as T&Cs, apply to all contracts for the rental of apartments and flats (units) for accommodation concluded between AnE United, owner Florian Knoll with its brand 247 Reside and a customer (guest), as well as to all other services and deliveries provided by AnE United (accommodation contract), unless the parties have made an individual agreement.
    2. The customer’s general terms and conditions shall only apply if this has been expressly agreed in writing between the parties beforehand.

  2. RESERVATION & CONCLUSION OF CONTRACT
    1. By making a reservation/booking, the guest offers to conclude an accommodation contract. If the booked unit is available, the guest will receive a reservation/booking confirmation from AnE United. This acceptance of the reservation made by the guest constitutes an accommodation contract between AnE United and the guest.
    2. If a third party has made the reservation/order for the guest and AnE United has received a corresponding declaration from the third party, the third party is jointly and severally liable with the guest to AnE United for all obligations arising from the accommodation contract. The third party is included within the scope of these Terms and Conditions.
    3. Offers from AnE United regarding available units are subject to change and non-binding. AnE United reserves the right to refuse to conclude an accommodation contract at its sole discretion.
    4. There is no entitlement to use the overnight service in a specific unit. AnE United reserves the right to define industry-standard restrictions such as minimum stays, booking guarantees, or deposits for specific travel dates.

  3. CANCELLATION, DEADLINES & NON-USE OF SERVICES (NO SHOW)
    1. A guaranteed reservation is only valid upon receipt of payment. This reservation can be canceled free of charge by the guest, providing the reservation number and adhering to the stated cancellation policy and cancellation deadlines. If the guest fails to meet their payment obligations on time despite a request from AnE United, AnE United reserves the right to cancel the reservation at any time.
    2. If no right of withdrawal has been agreed or the free cancellation period has already expired, there is no statutory right of withdrawal or termination and AnE United does not agree to a cancellation of the contract, AnE United retains the right to the agreed remuneration despite the non-use of the service (no show) or late cancellation by the guest.
    3. For guaranteed reservations of multiple days, in the event of a no-show, all subsequent nights from the first night onwards will be cancelled and the guest will not be entitled to any subsequent nights.
    4. For reservations made on the day of arrival, the guest must make payment for the stay in accordance with Section 5 immediately, usually within one hour.
    5. For bookings not made directly through the 247 Reside website, the cancellation policy of the respective third-party provider applies. All changes and cancellations to bookings must be made through the original booking website.

  4. ACCOMMODATION PRICES & OTHER PRICES
    1. At the time of contract conclusion, the prices quoted by AnE United apply. Applicable and quoted prices are gross prices and include all statutory taxes, fees, and charges. Local charges levied under the respective municipal law (e.g., tourist taxes) are the responsibility of the guest and are not included.
    2. In the event of changes to tax, fee, or levy rates, or the effective levy of new taxes, fees, or levies previously unknown to the parties, AnE United reserves the right to adjust prices accordingly. For contracts with consumers, this only applies if the period between conclusion of the contract (booking confirmation) and contract fulfillment exceeds four months.

  5. PAYMENT TERMS & INVOICE
    1. The total price for the overnight stay booked by the guest must always be paid in advance.
    2. Set-off by the guest is excluded unless the set-off concerns an undisputed or legally established claim.
    3. Accepted payment methods are MasterCard, Visa, American Express, Sofortüberweisung/Klarna, PayPal, and bank transfer. Cash payments are not accepted.
    4. AnE United reserves the right to charge any outstanding amounts for any fees subsequently incurred due to additional services used or violations of the General Terms and Conditions to the deposited payment methods. The guest expressly authorizes AnE United to do so.
    5. By making a reservation, the guest agrees that an invoice will normally always be made available as a download or by email.

  6. OPTIONS FOR USING RESERVED UNITS
    1. A reserved unit is available to the guest from 3:00 PM on the day of arrival until 10:00 AM on the day of departure.
    2. Upon request and subject to availability, an early check-in can be arranged in advance with AnE United. If AnE United approves an early check-in, AnE United is entitled to charge EUR 10.00 per hour or part thereof for the additional use of the unit.
    3. There is no contractual right to early check-in.
    4. Upon request and subject to availability, a later departure (late check-out) can be arranged in advance with AnE United. If AnE United agrees to a late check-out, AnE United is entitled to charge EUR 10.00 for each hour or part thereof for the additional use of the unit. If AnE United does not agree to a check-out after 11:00 a.m., AnE United is entitled to charge EUR 30.00 for each hour or part thereof.
      For departures after 2:00 p.m., the full daily rate for the unit will be charged if AnE United has agreed to a late check-out. If AnE United has not agreed to a late check-out, the guest is liable for any additional damages incurred in addition to the full overnight price. The guest has the option of providing evidence that AnE United has incurred lesser or no damages at all.
    5. There is no contractual right to a late check-out.
    6. The keys, key cards, and/or parking permits provided by AnE United must be returned to AnE United, a third party designated by AnE United, or at the location in the unit designated by AnE United via signage and/or a message on the day
      of departure. Loss of a key, key card, or parking permit, or failure to return these items, will incur a fee of EUR 40.00. AnE United is also entitled to charge the guest further compensation for any resulting damage if the damage exceeds EUR 40.00. This includes replacing the affected locking system if necessary for security reasons. The guest has the option of providing evidence that AnE United suffered less or no damage at all.

  7. TRANSFER, SUB-LEADING, USE
    1. Both subletting and subletting of the booked unit is prohibited. In particular, subletting units and/or unit quotas to third parties at prices higher than the unit prices stated by AnE United is not permitted.
    2. The assignment or sale of claims against AnE United is also not permitted. In these cases, AnE United is entitled to cancel the reservation, particularly if the guest has provided false information to third parties regarding the type of booking or payment at the time of assignment/sale.
    3. The use of the units provided by AnE United for purposes other than accommodation is expressly prohibited. This includes, in particular, any commercial or illegal use, such as prostitution or other illegal services and activities.
    4. The use of the units for photo or video recordings without explicit consent from AnE United is also prohibited.
    5. If a unit is used for any reason other than accommodation, AnE United reserves the right to cancel the reservation without refund and vacate the rental property.

  8. LIABILITY OF AnE United
    1. AnE United is liable without limitation for damages resulting from injury to life, body, or health. AnE United is also liable for other damages resulting from an intentional or grossly negligent breach of duty by AnE United. In the case of simple negligence, AnE United's liability is limited to the damage typically foreseeable under the contract, provided that a duty is breached whose fulfillment makes the proper execution of the contract possible and on whose compliance the guest can rely (cardinal duty). A breach of duty by AnE United is equivalent to a breach of duty by its legal representatives, employees, or vicarious agents.
      Further claims for damages are excluded unless otherwise provided in these Terms and Conditions.
    2. Should any disruptions or defects occur in AnE United's services, AnE United will endeavor to remedy the situation upon immediate notification by the guest or upon becoming aware of the situation. The guest is obligated to make reasonable efforts to remedy the disruption or defect and minimize any resulting damage.
      Furthermore, the guest is obligated to immediately notify AnE United of the possibility of significant damage.
    3. AnE United is liable for items brought into the unit in accordance with statutory provisions. Any potential claim expires if the guest fails to report the loss, destruction, or damage to the item brought into the unit to AnE United immediately after becoming aware of it, unless this delayed report has no impact on the clarification of the matter. Bringing money, valuables, or other valuables with a value exceeding EUR 800.00 or other items with a value exceeding EUR 3,500.00 into the unit requires a separate written agreement with AnE United. Otherwise, AnE United's liability for loss, destruction, or damage to these items is excluded.
    4. If a parking space is provided to the guest by AnE United, whether for a fee or free of charge, no safekeeping agreement is concluded. This does not create any monitoring obligation for AnE United. AnE United is only liable for loss, theft, or damage to parking spaces on the property and/or provided by or caused by parked or maneuvered vehicles if this was caused intentionally or through gross negligence.
      The guest is obligated to report any damage immediately. Obvious damage must be reported to AnE United before leaving the parking space. AnE United is not liable for damage caused solely by other guests or third parties.
    5. All claims against AnE United generally expire within one year from the start of the statutory limitation period. This does not apply to claims for damages or other claims arising from injury to life, limb, or health and/or due to grossly negligent or intentional breach of duty by AnE United, or in the event of a breach of a cardinal duty.     6. AnE United assumes no liability for lost property. This excludes liability for intentional or grossly negligent breaches of duty by AnE United. Lost property will only be returned upon request, subject to a fee of €15.00, and at the guest's own risk.
      AnE United undertakes to store lost property for a period of six months. Disposal will then follow.

  9. SECURITY DEPOSIT/SECURITY DEPOSIT
    1. To secure all claims arising from the accommodation contract between AnE United and the guest, AnE United is entitled to collect the following security deposits/security deposits from the guest before the units are provided:
      1. For a stay of less than three months, a security deposit of EUR 250.00
      2. For stays of less than three months, AnE United is entitled to request the security deposit/deposit by pre-authorizing the payment method to cover the security deposit. If the security deposit/deposit is not provided by the guest, the guest shall have no right to vacate the unit.
        In the event that AnE United has nevertheless provided the unit to the guest, AnE United may request the security deposit/deposit within a reasonable period of time. If the guest fails to comply with this request by the expiry of the period, AnE United is entitled to terminate the accommodation contract without notice.
      3. For a stay of three to six months, a security deposit of one monthly overnight stay

  10. CUSTOMER DATA
    1. To ensure efficient customer communication, AnE United is required to collect and record the guest's email address and telephone number. To verify the guest's identity, AnE United is entitled to digitally request a valid identification document upon check-in. For domestic guests, this is an identity card or passport; for international guests, this is always a passport.
    2. If the identity of a guest cannot be clearly established due to missing or false documents, AnE United reserves the right to cancel the booking and deny the guest access to the property.
    3. To prevent fraudulent and malicious bookings, AnE United uses software solutions that calculate a dedicated "Fraud Prevention Score" for each guest based on the data requested and collected from the guest (name, address, telephone number, email address, credit card information, etc.).
      Should such a booking be detected by the software and flagged accordingly, AnE United reserves the right to cancel the booking at any time.

  11. TERMINATION OF THE ACCOMMODATION CONTRACT
    1. AnE United is entitled to terminate the accommodation contract at any time for good cause. Good cause exists in particular if
      1. force majeure or other circumstances beyond AnE United's control make the fulfilment of the contract impossible; AnE United has reasonable grounds to believe that the use of the accommodation service could jeopardise the smooth running of the business, the security or the external impact and image of AnE United and its locations in the public eye, without this being attributable to the sphere of control or organisation of AnE United.
      2. Bookings are made negligently using misleading or false information or by omitting material facts. This may include, but is not limited to, the guest's identity, ability to pay, or the purpose of the stay.
      3. the purpose/reason for the stay is illegal or serves the purpose of residential prostitution.
      4. the case of unauthorized resale, subletting and/or sub-brokerage (see section 7) is the underlying cause.
    2. AnE United must immediately inform the guest of the exercise of the right of termination.
    3. In the event of a justified termination, i.e., if termination by AnE United occurs due to circumstances attributable to the guest or for a reason (according to Section 11, No. 1), AnE United is entitled to cancel or reject future bookings made by the guest, even if they have already been confirmed by AnE United. In the event of a justified termination by the accommodation provider, the guest is not entitled to compensation.

  12. VOUCHERS
    1. A voucher purchased from AnE United can only be redeemed for AnE United services. Any remaining balance on payments made with the voucher will remain valid and can be used for future bookings. Vouchers are non-refundable, non-resellable, non-transferable, and non-refundable, in whole or in part, for cash. The purchaser of the voucher is
      responsible for providing the correct information (especially the email address) to which the voucher and invoice should be sent.
    2. Cancellation policy: Declarations regarding vouchers can be revoked within 14 days without stating reasons in any form (letter, fax, email) or, if the voucher is provided before the expiration date, by returning the voucher. The period begins upon receipt of this instruction in text form, but not before the recipient receives the voucher. To comply with the cancellation period, it is sufficient to send the cancellation or the voucher in a timely manner.
      The cancellation must be addressed to AnE United, keyword: voucher; by email to: [email protected] .

  13. SMOKING PROHIBITION
    1. All AnE United units are non-smoking areas. Smoking is strictly prohibited in the units and in common areas of AnE United. This also applies to e-cigarettes, shisha pipes, tobacco heaters, and similar devices.
      Smoking on balconies and/or terraces is only permitted if appropriately marked and the unit door is closed.
    2. In the event of a violation, AnE United reserves the right to demand compensation from the guest for the additional cleaning costs, including any loss of revenue resulting from the unreasonable subletting of the unit due to the incident, in the amount of at least EUR 250.00. This amount of compensation may, however, be increased if AnE United can prove greater damages.
    3. AnE United reserves the right to terminate an active booking with immediate effect and remove guests from the premises if it becomes aware of any violations of the smoking ban. In these cases, there is no right to a refund or partial reimbursement. The guest has the opportunity to prove that AnE United has suffered less or no damage.

  14. IMPACT ON THE SAFETY OF PEOPLE & UNIT
    1. Tampering with or blocking emergency exits, fire extinguishers, or the fire/building alarm is prohibited. This also applies to tampering with or disabling security and decibel sensors within the unit.
    2. Violations will result in a penalty fee of EUR 2,500.00.
      Furthermore, the guest is fully liable, but at least for the actual costs incurred, as well as the actual costs that may arise from possible consequential events (e.g., damages resulting from injury to life, body, or health, or damage to the building/unit).
    3. AnE United buildings may contain networked smoke detectors that are directly connected to the fire department or security service control center. Guests are fully liable for any intentional or negligent activation of the fire alarm system (e.g., due to a violation of the smoking ban), but at least for the actual costs incurred (e.g., fire department or security service response costs).
    4. AnE United reserves the right to terminate an active booking with immediate effect and remove guests from the property if it becomes aware of any actions under Section 14, Nos. 1 & 3. In these cases, there is no right to a refund or partial reimbursement. The guest has the opportunity to prove that AnE United has suffered less or no damage.

  15. PROHIBITION OF CELEBRATIONS/PARTIES AND GATHERINGS
    1. Noise must be avoided in the booked unit, the common areas, and the surrounding grounds. Quiet hours must be observed from 10 p.m. to 6 a.m. ("Quiet Hours"), unless otherwise specified in the house rules. Parties and gatherings are strictly prohibited in AnE United units and common areas.
    2. In the event of a violation, AnE United has the right to demand compensation from the guest for the additional necessary cleaning costs, including any loss of revenue resulting from the unreasonable subletting of the unit due to the incident, in the amount of EUR 500.00. The right to further compensation remains unaffected. The guest has the opportunity to prove that AnE United has suffered lesser or no damages.
    3. AnE United units may be equipped with decibel sensors. These sensors do not record voices or conversations, but are used to detect excessive noise.
      Decibel sensors may also be installed in AnE United's common areas, such as hallways or other common areas, as well as active video surveillance, which records 24/7 and stores it in a cloud environment.
    4. AnE United reserves the right to terminate an active booking with immediate effect and expel guests from the property if it becomes aware of violations under Section 15, Points 1 & 2. In these cases, no claim to a refund or partial reimbursement exists. The guest has the opportunity to prove that AnE United has suffered less or no damage.
      AnE United reserves the right to enforce its house rules by utilizing the services of a third party, such as a security service. Any costs incurred through third-party intervention will be charged to the guest.

  16. DAMAGE OR UNAUTHORIZED REMOVAL OF INVENTORY
    1. If damage occurs during the stay that exceeds the contractual use, or if inventory is removed from the unit without authorization, AnE United is entitled to compensation. This includes, in particular, the costs of repairing the damage, including any loss of revenue resulting from the inability to rent the unit, legal costs, and a processing fee of EUR 50.00 for such damage. The guest has the opportunity to prove that AnE United has suffered lesser or no damage at all.

  17. PETS
    1. Bringing pets or animals is not permitted in units or common areas. Exceptions are guide dogs, deaf dogs, and other similar service dogs. These may be brought along free of charge and at any time upon presentation of proof.
      The relevant proof must be presented to AnE United prior to check-in.
    2. AnE United reserves the right to make further exceptions to the above policy. However, the guest is not entitled to these exceptions. If a pet is kept in a unit without permission, AnE United will charge a flat rate of EUR 150.00 for a special cleaning fee.
      AnE United reserves the right to terminate an active booking with immediate effect and evict guests from the property if violations of Section 17, Point 1 occur. In these cases, there is no right to a refund or partial reimbursement. The guest has the option of providing evidence that AnE United suffered less or no damage.

  18. MAINTENANCE
    1. By booking a unit from AnE United, the guest agrees to treat the unit, as well as any shared rooms, facilities, and equipment, with care and respect. Furthermore, the guest is responsible for ensuring adequate ventilation and heating, as well as avoiding excessive soiling. If soiling exceeds normal use during the guest's stay or after departure, AnE United reserves the right to charge the guest an additional cleaning fee of at least EUR 50.00 (depending on the condition of the unit). The guest has the opportunity to provide evidence that AnE United incurred less or no damage.

  19. INTERNET USE
    1. AnE United will provide guests with internet access within the scope of existing technical and operational capabilities. Disruptions due to force majeure, maintenance work, or similar events cannot be ruled out.
    2. The guest may not misuse the internet connection. Misuse occurs in particular in the following cases: downloading and distributing copyrighted content via peer-to-peer sharing platforms, illegal streaming services, cybercrime/cyberattacks, and the posting, retrieval, or transmission of criminally relevant content (in particular, Sections 130, 130a, 131, and 184 of the German Criminal Code). The guest is obligated to respect the copyright, patent, name, trademark, and personality rights of third parties when using the internet connection. The guest shall indemnify AnE United upon first request from all claims and demands for damages by third parties, as well as from reasonable legal defense costs, caused by the unlawful use of the internet connection provided by the guest or by third parties with the guest's knowledge. This indemnification claim includes, in particular, claims arising from the infringement of copyright, patent, name, trademark and personality rights as well as violations of data protection law.
    3. Guests are prohibited from sharing their access data for the AnE United internet connection with third parties. This also applies to publishing any access data. In the event of a violation, the guest is liable to AnE United for all damages resulting from the disclosure of the access data.
    4. AnE United also reserves the right to block the guest's internet connection in the event of legal violations.

  21. FINAL PROVISIONS
    1. Changes and additions, as well as the cancellation of the accommodation contract, the acceptance of an application, or these General Terms and Conditions, must be made in writing. This also applies to the cancellation of this written form clause. Unilateral changes or additions by the guest are invalid.
    2. The place of performance and payment is the registered office of the accommodation provider.
    3. The exclusive place of jurisdiction in commercial transactions is the registered office of the accommodation provider. If a contractual partner meets the requirements of Section 38 (2) of the Code of Civil Procedure and does not have a general place of jurisdiction within Germany, the place of jurisdiction shall be the registered office of the accommodation provider.
    4. German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict of laws is excluded.
    5. Should any provision of this agreement be or become invalid, void, or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid/unenforceable provision, the parties shall agree on a provision that most closely approximates the intended purpose of the invalid/unenforceable provision. This also applies to filling any gaps in the contract.
    6. The accommodation provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
